{"id":5180,"date":"2022-11-25T13:21:20","date_gmt":"2022-11-25T16:21:20","guid":{"rendered":"https:\/\/www.pellon.com.br\/?p=5180"},"modified":"2022-11-25T13:21:20","modified_gmt":"2022-11-25T16:21:20","slug":"consulta-publica-17-22","status":"publish","type":"post","link":"https:\/\/www.pellon.com.br\/?p=5180","title":{"rendered":"EXPRESSO: CONSULTA P\u00daBLICA 17\/22"},"content":{"rendered":"<div class=\"feed-shared-update-v2__description-wrapper\" tabindex=\"-1\">\n<div class=\"feed-shared-inline-show-more-text feed-shared-update-v2__description feed-shared-inline-show-more-text--minimal-padding feed-shared-inline-show-more-text--expanded \" tabindex=\"-1\" data-artdeco-is-focused=\"true\">\n<div class=\"update-components-text relative feed-shared-update-v2__commentary \" dir=\"ltr\"><span class=\"break-words\"><span class=\"break-words\"><span dir=\"ltr\"><br \/>\nProcedimentos Operacionais &#8211; Oferta Preferencial de Ressegurador Local e Contrata\u00e7\u00e3o de Seguro no Exterior<\/span><\/span><\/span>A SUSEP publicou no \u00faltimo dia 8, proposta de Circular para tratar dos procedimentos operacionais para: (i) oferta preferencial de riscos aos resseguradores locais; (ii) comprova\u00e7\u00e3o da insufici\u00eancia de oferta de capacidade dos resseguradores locais e estrangeiros para fins de transfer\u00eancia de riscos com resseguradores n\u00e3o autorizados a operar no Pa\u00eds e; (iii) a contrata\u00e7\u00e3o de seguro no exterior.<\/p>\n<p>Conforme se verifica da exposi\u00e7\u00e3o de motivos, a inten\u00e7\u00e3o \u00e9 consolidar a sistematizar as regras existentes a respeito dos tr\u00eas aspectos, tanto que a proposta revogar\u00e1 cinco circulares que tratam do tema. Al\u00e9m disso, haver\u00e1 adequa\u00e7\u00e3o redacional aos termos da Resolu\u00e7\u00e3o CNSP n\u00ba 241\/2011 e a LC n\u00ba 126\/2007.<\/p>\n<p>Vale notar que alguns prazos e marcos iniciais foram propostos, a exemplo do art. 7\u00ba que trata da comunica\u00e7\u00e3o \u00e0 SUSEP a respeito da opera\u00e7\u00e3o de cess\u00e3o, em 30 (trinta) dias a partir da vig\u00eancia do contrato. Por sua vez, o art. 8\u00ba tratou de estabelecer as regras operacionais para a consulta e registro de insufici\u00eancia de oferta de capacidade pelos resseguradores locais. Sendo certo que a aus\u00eancia de manifesta\u00e7\u00e3o no prazo estipulado ser\u00e1 entendida como recusa de cobertura.<\/p>\n<p>Por fim, o cap\u00edtulo III da norma disp\u00f5e sobre a hip\u00f3tese excepcional de contrata\u00e7\u00e3o de seguro no exterior, ap\u00f3s cumpridas as exig\u00eancias regulat\u00f3rias, especificamente a consulta a, no m\u00ednimo, cindo seguradores. O contrato nesse caso, n\u00e3o estar\u00e1 sujeito \u00e0 interfer\u00eancia da SUSEP para dirimir eventuais lit\u00edgios. Todavia, se alguma regra formal na contrata\u00e7\u00e3o for descumprida, sujeitar\u00e1 o ente supervisionado \u00e0s san\u00e7\u00f5es previstas. A contrata\u00e7\u00e3o dever\u00e1 ser informada em at\u00e9 60 (sessenta) dias do in\u00edcio de vig\u00eancia do risco.<\/p>\n<p>As sugest\u00f5es ser\u00e3o recebidas at\u00e9 o dia 22\/11\/2022.
